Summary. These Terms and Conditions govern your use of dreaming-tuscany.com and the purchase and use of Dreaming Tuscany memberships and related services. By accessing the site, creating an account, or purchasing a membership you accept these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the site or purchase a membership.

2) Relationship between these Terms and the Membership Agreement

Website access and pre purchase information are governed by these Terms. If you purchase a membership you will be asked to enter into the Dreaming Tuscany Membership Agreement. The Membership Agreement is incorporated by reference and governs the membership itself including benefits, fees, eligibility, cancellation, transfer, dispute resolution, limitations of liability, indemnification, and other conditions. If there is any conflict between these Terms and the Membership Agreement regarding membership matters the Membership Agreement controls.

3) Eligibility and accounts

  • You must be at least 18 years old to use the site and to purchase a membership.
  • You agree to provide accurate, current, and complete information and to keep it up to date.
  • Keep your login credentials confidential. You are responsible for activity under your account.
  • We may refuse service, close accounts, or cancel orders where permitted by law.

4) Membership overview

Subject to the Membership Agreement, Dreaming Tuscany offers a non exclusive and non transferable membership that provides access to certain benefits during the one year term. The current core benefits are summarized below and further detailed in Exhibit A of the Membership Agreement.

  • One week hotel accommodation in Tuscany for the Member and one adult guest in a single room, subject to availability and advance selection through our website.
  • Opportunity to enjoy Included Activities during Travel Week which currently include one boat tour up to 4 hours along the Tuscan coast in the Argentario area and participation in yoga and or cooking classes at a premium location. Activities require advance scheduling and may be modified or cancelled by us or providers. If cancelled we will use commercially reasonable efforts to arrange alternatives.
  • Travel accident insurance coverage during Travel Week. Coverage type and limits are determined at our discretion.
  • Monthly shipment for 12 months to a designated address within the United States of selected Tuscan goods which may include two bottles of Tuscan wine, olive oil, and other specialty products.
  • Such other benefits as we may offer from time to time.

Membership benefits are subject to availability. We may modify, add, or remove benefits with reasonable notice of any material change.

5) Fees, payments, taxes, and refunds

  • Membership fee. USD 15,000.00 per year unless otherwise stated in your order flow or agreement. Taxes, processing, and administrative fees are additional and are the Member’s responsibility.
  • Payment timing. Payable upon execution of the Membership Agreement.
  • Payment methods. Credit card, debit card, electronic funds transfer, or other methods we accept from time to time.
  • Refund period. You may cancel within five days after payment and receive a refund of the Membership fee less processing or administration fees incurred by the Company, by sending written notice within that period. After the refund period the fee is non refundable except as required by law or expressly stated in the Membership Agreement.
  • Late payments. If payment is not made when due we may suspend access to benefits or terminate the Agreement.

6) Travel week scheduling, rescheduling, and transfer

  • Select hotel accommodation at least one month before Travel Week. Selections are first come first served and availability varies.
  • You may reschedule Travel Week one time during the term if you provide written notice at least one month before the scheduled start.
  • If you cannot reschedule as required you may request a Travel Week Transfer of the Travel Week related services and benefits to a third party. Approval and any modification of services are at our sole discretion.

7) Guests and minors

  • You may bring one adult guest. You may also bring one minor child for free up to age four.
  • For a minor child aged five to eleven an additional charge of USD 3,000.00 applies. For a minor child aged twelve to seventeen an additional charge of USD 5,000.00 applies. Additional charges may apply depending on circumstances.
  • The Member is responsible for ensuring that any guest or child complies with all rules and obligations.

8) Member conduct

Members and their guests must act professionally and courteously with our representatives, travel providers, and other members and must not engage in fraudulent, deceptive, or illegal activity. If conduct becomes unacceptable in our discretion we may terminate the Agreement immediately without refund as set out in the Membership Agreement.

9) Travel arrangements and third party providers

  • Members are responsible for travel documents, visas, permits, vaccinations, and compliance with laws and provider rules.
  • Costs not expressly included in membership benefits such as airfare, meals, and incidentals are the Member’s responsibility.
  • Dreaming Tuscany is not a travel agency, tour operator, or common carrier and does not own, operate, or control the travel services, accommodations, or transportation providers used to fulfill benefits.

10) Shipments of selected goods

  • Monthly shipments are delivered to a United States address designated by the Member. Delivery schedules can vary for reasons beyond our control.
  • Shipments may include wine. An adult age 21 or older must be present to sign upon delivery. Shipment of alcohol is subject to federal, state, and local law and to carrier policies. We may decline or substitute products or adjust shipping methods to comply with applicable law.
  • You are responsible for providing a valid delivery address and for any redelivery fees. Title and risk of loss pass at the time the carrier accepts the shipment.

11) Intellectual property and site license

The site and its content are owned by Dreaming Tuscany or its licensors and are protected by law. We grant you a limited, non exclusive, non transferable license to access and use the site for personal and non commercial purposes. You may not copy, modify, reverse engineer, or exploit the site or content except as allowed by law or with our written permission.

12) Privacy and cookies

Your personal information is processed according to our Privacy Policy. We use cookies and similar technologies as described in our Cookie Policy. You can manage cookie choices using the banner controls. California residents can use the Do Not Sell or Share link in the banner or here.

13) Disclaimers

Except as expressly stated in the Membership Agreement, services are provided as is and as available. We do not warrant that membership benefits or the site will meet your requirements or be uninterrupted, timely, secure, or error free. The quality, safety, reliability, and suitability of third party services are the responsibility of those providers and you assume related risks.

14) Limitation of liability

To the maximum extent permitted by law Dreaming Tuscany will not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, goodwill, data, or use that arise out of or relate to these Terms, the Membership Agreement, or the benefits. The total liability to a Member for all claims will not exceed the membership fee paid by the Member during the twelve months immediately preceding the event that gave rise to liability. These limits apply whether the claim is based in warranty, contract, tort including negligence, or any other legal theory.

15) Indemnification

You agree to indemnify and hold harmless Dreaming Tuscany and its officers, directors, employees, agents, and representatives from claims, losses, liabilities, damages, and expenses including reasonable attorneys fees that arise from your breach of these Terms or the Membership Agreement, your use of the site or benefits, your violation of law, or your negligence or willful misconduct. This obligation extends to your guest and child.

16) Confidentiality

Each party may share confidential or proprietary information with the other. Each party will protect the other party’s confidential information, will use it only to perform obligations or exercise rights, and will not disclose it except as required by law or with consent. The standard exceptions for information that is public, independently developed, rightfully received, or previously known apply.

17) Termination

You may terminate your membership as stated in the Membership Agreement. We may suspend or terminate accounts or memberships for failure to pay, material breach not cured after notice, fraud or illegal activity, or conduct harmful to our reputation or business interests. On termination all rights to benefits cease and outstanding amounts remain payable. The provisions that by their nature should survive will survive.

18) Dispute resolution, governing law, and venue

These Terms and the Membership Agreement are governed by the laws of the State of Nevada and applicable federal law without regard to conflict of law rules. Disputes will follow the alternative dispute resolution process and arbitration requirements set out in Article Eleven of the Membership Agreement including mandatory binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association if mediation does not resolve the matter. Actions that must be brought in court will be filed in a state or federal court in Nevada in the county of or nearest to our principal office, and the parties consent to those courts. Jury trial is waived as provided in the Agreement. Equitable relief is available where appropriate.

19) Force majeure

Neither party is liable for delays or failure to perform due to causes beyond reasonable control such as acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor disputes, or internet service failures. Fees already paid remain non refundable except as expressly stated in the Membership Agreement or required by law.

20) Notices

Unless stated otherwise, notices must be in writing and are deemed given when delivered by hand with written confirmation, when received if sent by recognized overnight courier, on the date sent by email during normal business hours or the next business day if sent after hours, or on the third day after mailing by certified or registered mail with return receipt. Send notices to the addresses provided above unless updated in writing.

21) Changes to these Terms

We may update these Terms to reflect changes in our services or in the law. If changes are material we will provide a prominent notice on the site. Your continued use of the site or membership after changes become effective means you accept the updated Terms.

22) Electronic communications and signatures

By creating an account, purchasing a membership, or communicating with us you consent to receive communications electronically and to transact electronically. If you prefer paper copies you may request them by contacting us.

23) Assignment

You may not assign or transfer your rights or obligations without our prior written consent. We may assign or transfer our rights or obligations to a third party. Subject to these limits, these Terms bind and benefit the parties and their permitted successors and assigns.

24) No third party beneficiaries

These Terms are for the sole benefit of Dreaming Tuscany and the Member and their respective successors and assigns. No other person has rights under these Terms.

25) Severability and waiver

If any provision is held invalid the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of future enforcement of that or any other provision.

26) Entire agreement

For website use these Terms and any policies referenced here such as the Privacy Policy and Cookie Policy make up the entire agreement between you and Dreaming Tuscany regarding the site. For membership matters the Membership Agreement together with these Terms and referenced policies is the entire agreement between the parties regarding the membership.
